The use of services provided by MDDHosting LLC (hereafter referred to as "MDDHosting") constitutes agreement to these terms.
MDDHosting offers a 30-day unconditional money-back guarantee for managed cloud, Turbo, Plaid, shared, premium, and Elastic reseller services. If you are not completely satisfied with our services within the first 30 days, you are eligible for a full refund.
To receive a refund, simply submit a cancellation for the qualifying service within the first 30 days. No additional steps are required. Refunds are processed within 7 days of the cancellation request and may take 7 to 14 days to appear on your credit card or bank statement.
Services excluded from this guarantee include domain registrations, domain renewals, dedicated servers, virtual private servers (VPS), licenses, design services, or any other services not explicitly covered.
If the server hosting your service experiences physical downtime exceeding 1 hour, you are eligible to request service credits equal to 10 times the duration of the downtime. For example, if your server is down for 1 hour, you are eligible to request 10 hours of service credit as compensation.
Requests must be submitted to the billing department within 7 days of the downtime. Requests must include the dates and times of the downtime, the service affected, and any additional information that may assist us in verifying the downtime.
Terms and Conditions:
MDDHosting will make every reasonable effort to migrate your content from your current provider to us. In cases where an exact migration is not feasible, we will communicate this to you.
We will maintain communication with you throughout the migration process, providing updates on the status, notifying you upon completion, and informing you promptly if any issues arise.
cPanel Migrations: If migrating from a cPanel-based provider, we can generally copy everything exactly as it was at your current provider. This is contingent on the current provider making full cPanel Backups available to you/us. If full cPanel backups are not available we will make every reasonable effort to migrate your content manually.
Non-cPanel Migrations: When migrating from a provider that does not run the cPanel software the process is completely manual and may take more time and effort on our part.
Re-migration of accounts may incur a fee of $5 per cPanel account or $25 per non-cPanel account.
Turbo / Plaid / Plaid Plus Shared Cloud Hosting Migrations
We aim to complete migrations within 24 to 48 hours, though some transfers may take longer or may be significantly shorter depending on circumstances. The average migration only takes a few hours.
Turbo / Plaid Elastic Reseller Hosting Migrations
When migrating from a cPanel based service where you have access to Web Host Manager ("WHM") we will migrate as many 25 cPanel accounts per month without any charge. We will always restore cPanel backup files that you upload to your reseller service with us at no cost. For example if you wish to restore 100 cPanel accounts and you upload the cPanel backups of those accounts to your service with us we will restore them at no charge.
You agree to supply appropriate payment for the services received from MDDHosting, in advance of the time period during which such services are provided. You agree that until and unless you notify MDDHosting of your desire to cancel any or all services received according to our Cancellations and Refund Policy those services will be billed on a recurring basis and automatically charged to the payment method on file on the due date.
We accept Visa, MasterCard, Discover, American Express, and PayPal. We will accept mail-in payments on annual or longer billing cycles only, any mail-in payments received for monthly, quarterly, or semi-annual billing cycles will be voided and shredded. We will accept checks, money orders, and cashier's checks for mail-in payments. We will not accept cash payments.
As a client of MDDHosting, it is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. MDDHosting provides a 7 day grace period from the time the invoice is due and when it must be paid. The grace period is a courtesy and may be rescinded at MDDHosting's sole discretion if a client's account is chronically overdue. Any service that becomes 7 days overdue will be suspended until all overdue invoices within the client account are paid. Any account that is overdue for 30 days and has not paid will be automatically terminated.
Customers may cancel at any time via the cancellation form in your client dashboard.
We believe in fair billing practices and do not want to retain your payment for services you no longer need or want. If you cancel a service, we will issue a pro-rated refund for any unused time, calculated in whole months during which the service was not active. For example, if you purchase a 12-month service plan and cancel after 3 months and 10 days, you will receive a refund for the remaining 8 full months of service.
Cancellations must be submitted via our Billing and Support system at http://www.mddhosting.com/support/. This is for the protection of your services with us against fraudulent, malicious, or unauthorized cancellation requests. We strive to make the process as simple as possible and full step-by-step cancellation directions can be found in our knowledgebase. Cancellations requested via e-mail, support ticket, or live chat will not be honored and directions will be provided to submit a cancellation via our Billing and Support system.
We will email the primary account email address a cancellation request confirmation when a cancellation is submitted. Please make sure to check your spam/junk folder. If you do not receive a cancellation request confirmation, and you have checked your spam/junk folder, please contact us immediately so that we can confirm your cancellation request.
Elastic Reseller resources such as cPanel accounts, disk space, and bandwidth are billed based on usage. Upon account cancellation, an invoice will be generated for any un-billed usage that has occurred from the last invoice date to the date of cancellation. This invoice will be due upon receipt.
There are no refunds for credit deposits, credit balances, lifetime plans, design services, domain registrations, domain renewals, dedicated servers, virtual private servers ("VPS"), or licenses. Licenses including, but not limited to: cPanel Licenses, Softaculous Licenses, WHMCS Licenses, and LiteSpeed Licenses.
If your services are terminated illegal activity or violations of these Terms of Service no refunds or credits will be granted.
We screen all orders for fraud prevention and we may require additional information to verify your identity. You have no obligation to provide the requested additional information although we reserve the right to deny your order if we request additional information and it is not provided.
We do not recommend using an email address @ the domain you are signing up for. If, for example, you intend to host "example.com" with us, we do not recommend using an email address that ends in "@example.com" as this may cause issues with account verification and password resets.
It is your responsibility to ensure the email address on file is current or up to date at all times. Providing false contact information of any kind may result in the termination of your account or the rejection of your order.
We reserve the right to reject any order at our sole discretion. We also reserve the right to place any account on hold until we receive additional information to verify the account holder's identity.
All services provided by MDDHosting may only be used for lawful purposes.
MDDHosting reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.
Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account.
You may not add any domain to your account(s) or service(s) with us for which your usage of domain has not been authorized by the domain's owner(s).
Examples of prohibited material on all Shared, Reseller, Premium, VPS, and Dedicated Servers include:
Explicit Adult Content [such as pornography], IRC Bots, ClickJackers, proxy scripts / anonymizers, pirated software / nulled software / warez, public image dumps (similar to PhotoBucket), public file dumps (similar to RapidShare), RapidLeech, game servers, commercial banner ad services, commercial audio streaming (more than one or two streams), escrow, high-yield interest programs(HYIP) or related sites, investment sites (FOREX, egold exchange), sale of any controlled substance without prior proof of appropriate permit(s), AutoSurf sites, bank debentures, bank debenture trading programs, prime banks programs, lottery sites, muds / RPGs, hate sites, hacker focused sites/archives/programs, sites promoting illegal activities, IP scanners, brute force programs, mail bombers, spam scripts, and forums that distribute and/or link to warez content.
Any material that, in our judgment, is obscene or threatening is prohibited and will be removed from our servers with or without notice at our sole discretion.

Potential harm to minors is strictly forbidden, including but not limited to real child pornography, AI generated child pornography, or content perceived to be child pornography (Lolita):
Any site found to host child pornography or linking to child pornography will be suspended immediately without notice.
Resellers: we will suspend the site in question and will notify you so you may terminate the account. We have zero tolerance for child pornography. More than one instance of child pornography will result in the termination of your client account and all related services.
Direct customers: Your services will be terminated immediately with or without notice.
All child pornography will be reported to the appropriate law enforcement agency.
The security of your support and billing system, cPanel, WHM, FTP, and SSH credentials are your responsibility. You are required to maintain a strong, secure, unique password for these services. We recommend your passwords be no fewer than 12 characters and include at least one of each of the following: an upper case letter, a lower case letter, a number, and a symbol.
We strongly recommend rotating your password at least once every 3 months. Additionally the passwords assigned to each service should be unique and should not be shared from service to service. For example you should not use a password assigned to your cPanel account for your email account, for social media, or other online platforms. The password used for your client account in our system should also not be the same as the password assigned to your cPanel account.
We make available and strongly recommend Two-Factor Authentication ("2FA") for your client account, cPanel, and WHM. We strongly recommend enabling 2FA for all services that support it, not just those provided to you by MDDHosting.
All software must be kept up to date, including scripts, plugins, and themes, or otherwise be secured against unauthorized intrusion or hacking. In the event that we are made aware of an account that has been compromised or hacked, we may immediately limit web access with a username and password or suspend the service pending a full investigation.
We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. Any account found to be sending spam will be suspended and/or terminated with or without notice at our discretion. All purchased lists even if offered as a "safe list" or "double opt-in" will be treated as spam. Any user who sends out spam may have their account suspended and/or terminated with or without notice. Please read this for our generalized mail policy.
Sites advertised via SPAM (spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted may be immediately suspended and/or terminated at MDDHosting's sole discretion.
Messages forwarded off-network will be scanned for SPAM. If a forwarded message is determined to be SPAM it will not leave our network. When a message is forwarded off network and reported as spam the forwarder may be disabled to protect our mailing reputations for all of our clients.
Any account found to be hosting a phishing page will be suspended and/or terminated with or without notice at our discretion. Phishing is defined as any site that masquerades as another trustworthy site in attempts to acquire sensitive information such as usernames, passwords, credit card information, banking information, pin numbers, or any other personal information.
Phishing pages result in stolen identities, stolen banking information, stolen credit card information, and fraud that can cause the victims of these pages weeks, months, years, or even a lifetime of problems. Due to the serious issues that phishing pages cause, phishing is not something that is taken lightly. In the event that your account is suspended for phishing there is a very good chance that your account will not be re-enabled.
Any account suspended or terminated due to a phishing policy violation will be ineligible for refund.
As required by the ICANN we will send a domain renewal notice 30 days and 5 days prior to expiration as well as 5 days after expiration.
We renew domains 7 days prior to their expiration to allow time to resolve any issues that may arise preventing the renewal of the domain such as but not limited to: an expired credit card, insufficient funds in your PayPal account, bank holidays, etc.
If a domain is set to auto-renew we will attempt to renew it automatically on the renewal date. If the domain fails to renew on the renewal date we will try again on the expiration date. If a domain is set to not auto-renew you will still receive the renewal notices 30 days and 5 days prior to expiration as well as the reminder 5 days after expiration although we will not attempt to renew the domain for you. If you do wish to renew a domain that is set to not auto-renew you can do so manually from the domain details in our support system.
While MDDHosting does maintain backups of your files and/or data on our Cloud, Shared, Reseller, Elastic, and VPS platforms we accept no responsibility should backups be unavailable for any reason including but not limited to data corruption, hardware failure, or negligence.
Your use of the service is at your sole risk. MDDHosting is not responsible for files and/or data residing on your account.
You agree to take full responsibility for files and data stored on MDDHosting servers or services and to maintain all appropriate off-server backups of files and data stored on MDDHosting servers.
Any account larger than 25 gigabytes or those that generate more than 250 gigabytes of monthly changes may, at our discretion and with notification, be excluded from our backup systems.
All backups including but not limited to cPanel backup files, such as backup-*.tar.gz and cpmove-*.tar.gz, older than 72 hours will be removed from the server automatically and we suggest downloading said backups to an off-server location.
Dedicated servers are not backed up by MDDHosting. You may reach out to our sales department to obtain additional drive(s) for in-server backups.
Users may not:
You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, or charge you an additional fee for the overages.
Bandwidth overages will be billed at the rate of $0.10 per gigabyte of data transferred beyond your monthly bandwidth allocation. Unused transfer in one month cannot be carried over to the next month or refunded.
Resellers are responsible for supporting their clients. MDDHosting does not provide end-user support to our clients of our resellers. If a reseller's client contacts us, we will advise them to contact the individual or business with whom they obtained services from. We may, at our discretion, reach out to you to advise you of such contact from one of your clients.
All support requests must be made by the reseller. As a reseller you are the first line of support, we do not provide end-user support for the clients of our clients.
Resellers are responsible for all content stored or transmitted under their reseller account and the actions of their clients. MDDHosting will hold any reseller responsible for any of their clients actions that violate the law or these terms of service.
We do our best to optimize our servers and network for optimal performance. As a part of this optimization we may perform optimization on your content to reduce your load times and increase the overall performance of your websites including but not limited: enabling caching, installing plugins, or disabling plugins. In the event that you do not wish for us to do this please let technical support know and we can flag your account so that we do not take such actions.
MDDHosting reserves the right to terminate or suspend the refer-a-friend program or an individual user at any time. Any malicious manipulation of the refer-a-friend program including, but not limited to, cookie stuffing, the use of traffic exchanges, spam, trademark PPC bidding, or incentive offers will result in your permanent removal from this program.
All sales must originate from the customers' unique tracking link. The tracking URL we provide must not be altered. It is unique to each customer and any changes could result in credit not being properly assigned. MDDHosting will not be responsible for, nor give credit for, sales that do not have your unique tracking URL attached to it.
Customers cannot earn credit on their own hosting accounts. Referrals must be new customers.
Refer-a-friend commissions are credited after the referred client has active services for 30 days. Should the referred services be refunded for any reason including but not limited to under our money back guarantee, cancellation, chargeback, or dispute the referral commissions will be voided.
We make no representation that either our site or that the Refer-A-Friend program will be uninterrupted or error-free. We will not be liable for any consequences of interruptions or server down time.
The amount you pay for your service will never increase from the date of purchase without prior notice. In the event that your price is increased we will send an email to the primary email address on the account notifying you of the increase.
We reserve the right to change prices listed on MDDHosting.com, offer promotions and discounts for new clients and new services, discontinue or create new services, and to increase the amount of resources given to plans at any time.
We do regularly offer discounts and promotions for new services and clients. These discounts and promotions are often non-recurring and the renewal at normal pricing does not constitute a price increase.
Customer agrees to defend, indemnify, and hold MDDHosting, its officers, employees, and agents harmless from any and all claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising directly from (1) the customer’s use of MDDHosting services in violation of these Terms of Service; (2) any material provided by the customer that infringes upon the rights of any third party, including intellectual property rights; (3) any injury to person or property caused by a product sold or distributed by the customer in connection with MDDHosting services; or (4) any willful misconduct or gross negligence by the customer or their representatives.
This indemnification obligation shall not apply to liabilities caused by the gross negligence, willful misconduct, or breach of contract by MDDHosting.
To the fullest extent permitted by applicable law, MDDHosting, its officers, employees, and agents shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of or inability to use MDDHosting services. This includes, but is not limited to, damages for loss of profits, data, or business opportunities, even if MDDHosting has been advised of the possibility of such damages.
MDDHosting’s total liability for any claims arising under these Terms of Service shall be limited to the amount paid by the customer for the specific service during the six (6) months preceding the claim. This limitation shall not apply to damages resulting from MDDHosting’s gross negligence, willful misconduct, or violations of applicable law.
By using any MDDHosting services, you agree to resolve any disputes or claims arising out of or relating to these services exclusively through binding arbitration. Arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA) or another mutually agreed-upon arbitration provider. The arbitration will take place in Morgan County, Indiana, USA and the arbitrator’s decision will be final and binding.
Each party will bear its own legal fees and expenses, while the costs of arbitration will be governed by the applicable arbitration rules. Customers may, however, bring qualifying claims in small claims court in Morgan County, Indiana, USA if the claim is within the jurisdictional limits of such court.
This arbitration agreement does not waive any rights or remedies provided by applicable consumer protection laws.
To the fullest extent permitted by applicable law, MDDHosting makes no warranties of any kind, express or implied, regarding the services we provide. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement.
MDDHosting shall not be liable for any damages your business may suffer, including, but not limited to, loss of data, revenue, or profits, or any other consequential, incidental, or indirect damages arising from delays, service interruptions, data loss, or incorrect deliveries, whether caused by MDDHosting, its employees, or its agents.
This disclaimer does not apply to damages resulting from MDDHosting’s gross negligence, willful misconduct, or violations of applicable law.
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of this Agreement remain in full force and effect. Any partially invalid or unenforceable provision will remain enforceable to the extent permitted by law.
MDDHosting may disclose subscriber information, including files, databases, access logs, and other account data, to law enforcement agencies in response to valid legal requests, such as subpoenas, court orders, or other lawful processes.
MDDHosting will comply with all applicable laws and regulations regarding such disclosures, including data privacy laws where applicable. Unless prohibited by law or court order, MDDHosting may attempt to notify the subscriber of any such disclosures.
MDDHosting reserves the right to modify or update these Terms of Service at any time, with or without prior notice. Any changes will take effect immediately upon being published on our website or communicated to you by other means. We encourage you to review these Terms of Service periodically to stay informed of any updates or changes.
By agreeing to these terms of service you agree to have read and understood not only this document, but our privacy policy, unlimited policy, support scope, and our mailing policy documentation and agreements.
